These rules apply to the 2015 EnGAYged Wedding EXPO Giveaway ("Giveaway") presented by EnGAYged Weddings, The Original LGBT EXPO, Los Altos de Eros, Steven Rosen Photography, Reverend Will Mercer, Brent and Jess, Perfect Limo Service, Intercontinental Times Square, NYC Flower Project, Capriccio Ensemble, Connextions Magazine and Haute So Sweet ("Sponsors"), with rules posted at www.engaygedweddings.com/engayged-wedding-expo/lgbt-wedding-ceremony-honeymoon-giveaway.html ("Official Rules"). The Giveaway will start at 12:00:00 AM Eastern Time on December 25, 2014 and will end at 11:59:59 PM Eastern Time on February 12, 2015 ("Giveaway Entry Promotion Period").

 

By Entering the Giveaway, you agree to the Terms in these Official Rules.

  

1. CONDITIONS OF ENTRY:

The 2015 EnGAYged Wedding EXPO Giveaway is open to all Same-Sex Couples who are engaged to be married and are legal residents of the continental United States and 21 years of age or older at time of entry. Limit one entry per Couple ("Giveaway Entrant"). Void where prohibited by law. Giveaway Entrants must be physically located in the contiguous United States (not valid in AK, HI, U.S. Virgin Islands, and PR).

 

Employees of EnGAYged Weddings Inc., The Original LGBT EXPO, Los Altos de Eros, Steven Rosen Photography, Reverend Will Mercer, Brent and Jess, Perfect Limo Service, Haute So Sweet, NYC Flower Project, Cappricio Ensemble, Connextions Magazine, Intercontinental Times Square, and all persons working as employees for their affiliated companies, or the sponsors, agencies, distributors, subsidiaries, advertising and promotion agencies and affiliated companies, participating advertisers and media, employees, their immediate family members and/or those living in the same household of each are not eligible to be Giveaway Entrants. Immediate family member is defined as husband, wife, children, mother, father, sister, sister in-law, brother or brother in-law.

 

Giveaway is subject to all applicable Federal, State and Local Laws and Regulations. All Federal, State and local taxes are the sole responsibility of the winner ("Giveaway Winner"). Giveaway Prize is not transferable. No Giveaway prize substitutions.

  

Entry into this Giveaway constitutes permission to the Sponsors and their agencies to use all Giveaway Entrants' names, love stories, photos and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. Giveaway Entrant assigns and licensees, an unrestricted right and license to publicize, broadcast, display and/or otherwise use the Giveaway Entrant’s photos, love story, name, city, state, and biographical material (collectively, “Licensed Rights”) in any form or media now known or hereafter devised throughout the world in perpetuity for advertising and publicity purposes, without additional review, compensation, permission, or approval.

 

Sponsors reserve the right to substitute prizes of equal or greater value. There may be different graphics and presentations of this Giveaway.

 

By participating in this Giveaway, Giveaway Entrants agree to be bound by the Official Rules and the decisions of the Sponsors. Giveaway Entrants agree to release and hold harmless EnGAYged Weddings Inc., The Original LGBT EXPO, Los Altos de Eros, Steven Rosen Photography, Reverend Will Mercer, Intercontinental Times Square, Brent and Jess, Perfect Limo Service, NYC Flower Project, Capriccio Ensemble, Connextions Magazine and Haute So Sweet, their agencies, employees and sponsors ("Released Entities") from injury, death, loss or other liability that may arise from the acceptance or use of any prize or their participation in this Giveaway promotion.

 

All Entries Must be Received by 11:59:59 PM ET on February 12, 2015

 

2. ENTER VIA THE INTERNET:

Giveaway Entrants will submit a short story and photo(s) that best showcase the couple’s love story and why they feel that they should win the Giveaway. All Giveaway Entrant's essay content and photos must be completely original to the Giveaway Entrant and must not have been taken or composed, in whole or in part, from any other source other than the Giveaway Entrant, and must not have been released commercially in order to be entered into this Giveaway.

 

Submit Your Love Story and Couple's photos to Entry@engaygedweddings.com. The following information is required to be submitted in your e-mail: Name of Entrant and their fiancé, phone number(s), e-mail address, and address. Incomplete entries will not qualify to be entered into the EnGAYged Wedding EXPO Giveaway. The email address provided will be the identity of the Giveaway Entrant and, if selected, the identity of the Giveaway Winner. We expressly reserve the right to disqualify any entries that we believe in good faith are generated by an automated program or via scripts.

 

The top love stories, as judged by a panel of Sponsors, will then be published on the Sponsors' websites and social media. Based on the number of re-tweets, likes and re-pins (votes) received by the deadline of February 12th, 2015, at 11:59:59 PM ET, Sponsors will select the the final group of entrants ("Qualified Entrants"). Odds of being a Qualified Entrant depend on the number of Giveaway Entrants received, the submitted love story, Couple's photos, and the number of social media votes.

 

A couple will be selected in a random drawing from all Qualified Entrants on February 13, 2015 ("Potential Winner"). Odds of being a Potential Winner depend on the number of Qualified Entrants received. The Potential Winner will be notified by email and by phone. It is the Giveaway Entrant's responsibility to keep the email address and phone number used to enter active until the end of the Giveaway if they wish to be notified as a Potential Winner.

 

The Potential Winner will be required to respond to an email from the Sponsors with a reply e-mail message within twenty-four (24) hours of being contacted as the Potential Winner or such Potential Winner will be disqualified. If a Potential Winner (i) does not respond as described above, (ii) is found to be ineligible, or (iii) his/her prize notification is returned as undeliverable, such Potential Winner will be disqualified and, at Sponsors' sole discretion, an alternate Potential Winner may be selected from the remaining Qualified Entrants. Sponsors are not responsible for fraudulent calls, or e-mail messages made to Giveaway Entrants not by the Sponsors.

 

An Affidavit of Eligibility/Liability will then be mailed to the Potential Winner. This must be signed and returned to the Sponsors within 3 days of receipt. If the Affidavit is not returned within the set time period an alternate Potential Winner will be selected. The Potential Winner can not be declared the Giveaway Winner until the Affidavit is returned to the Sponsors and it is confirmed that all Official Rules have been met.

  

3. INTERNET ENTRY CONDITIONS: 

Sponsors assume no responsibility for lost, late, misdirected, illegible, incorrect or inaccurate entry information whether caused by an internet problem or the individual completing the entry. Sponsors reserve the right, in their sole discretion, to cancel or suspend this Giveaway should a cause beyond the control of the Sponsors corrupt the administration, security or proper operation of the Giveaway. Any attempt by an individual to deliberately undermine the legitimate operation of the Giveaway is in violation of criminal and civil laws. Should such an attempt be made, Sponsors reserve the right to seek damages from any such individual to the fullest extent permitted by law. Giveaway is governed by the laws of the state of Florida.

 

If for any reason this Giveaway is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors or the Released Entities which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, the Sponsors and the Released Entities reserve the right at their sole discretion, to disqualify any individual who tampers with the entry process.

 

Neither the Sponsors nor any of the Released Entities assume any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Neither the Sponsors nor any of the Released Entities are responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsors or any of the Released Entities due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to a Giveaway Entrant's or any other person's computer relating to or resulting from participating in this Giveaway or downloading any materials in this Giveaway. 

 

NEITHER SPONSORS NOR ANY OF THE RELEASED ENTITIES ARE RESPONSIBLE FOR INCOMPATIBILITY OF GIVEAWAY ENTRANT'S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY WITH SPONSOR'S OR SUCH RELEASED ENTITY’S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS OR AFFECTED RELEASED ENTITY RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. 

 

In the event of a dispute as to the identity or eligibility of a Giveaway Winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address at time of entry. "Authorized Account Holder" is defined as the natural person 18 years of age or older who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsors may ask any Giveaway Entrant or Potential Winner to provide Sponsors with proof that such party is the Authorized Account Holder of the email associated with the entry.  

 

4. GIVEAWAY PRIZES AND THEIR APPROXIMATE RETAIL VALUE: 

A total of one (1) Giveaway Ceremony and Honeymoon Package will be given away which includes:

 

(1) Grand Prize Winner and one (1) Guest to stay in Costa Rica at Los Altos de Eros. Honeymoon Package Includes: 4 nights accommodations in an Eros Suite, Private airport transfers, Breakfast and lunch daily, Personal Chef prepared dinner nightly, Transportation to beaches and towns, Complimentary beverages: beer, wine, smoothies, soft drinks, and cocktails, Laundry service. (Total Honeymoon prize is $5,000.00 USD).

 

(1) Wedding Ceremony Package in New York City which includes round trip service in a luxury sedan or SUV provided by Perfect Limo Service (Total Wedding Transportation prize is $450.00 and includes gratuity).

 

(3) Nights stay February 26, 27, 28 - 2015 for two Guests at Intercontinental Times Square featuring 2 floor to ceiling windows offering expansive views of the city below, 42-inch HDTV and large spa inspired bathroom with walk-in rain shower. (Total Manhattan Hotel prize is $2,000.00).

 

(1) Wedding Photography Package provided by Steven Rosen Photography which includes an engagement session lasting up to 2 hours taking place on a day to be determined before the wedding day, Up to 3 hours of coverage on the wedding day to include the ceremony and getting ready shots, and a $500 credit for the couple towards prints or an album. (Total Wedding Photography prize is $3,750.00).

 

Round Trip airfare for (2) to and from New York City for the Couple, up to (20) Complimentary Guest Badges for the Couple's Wedding Guest List, and (1) 20 X 20 foot Wedding Ceremony Stage provided by The Original LGBT EXPO (Total Plane Tickets, EXPO Tickets and EXPO Space prize is $6,400.00).

 

(1) Original Wedding Cake provided by Haute So Sweet (Total Wedding Cake prize is $4,200.00)

 

(1) Wedding Ceremony to be officiated by Reverend Will Mercer at The Original LGBT EXPO February 28, 2015 at 2pm at The Jacob Javits Convention Center in Manhattan, NYC. (Total Officiant Prize is $).

 

(2) 6mm 14k white comfort fit flat you & me wedding bands custom engraved with the Couples' fingerprints to be provided by Brent and Jess (Total Wedding Ring prize is $2,500.00). 

 

(2) Floral Altar Arrangements, (2) Boutonnieres, and (2) Bridal Clutch Bouquets to be provided by NYC Flower Project (Total Floral Package Prize is $).

 

Ceremony Music performed by Capriccio Ensemble (Total Music Prize is $).

  

The Internal Revenue Service requires Form 1099 MISC to be issued and filed for any recipient who receives a prize, if the annual aggregate value of the prize received is $600 or more. Sponsors will issue a Form 1099 MISC to the Grand Prize Winner for the market value of the Grand Prize. All prizes will be awarded provided they are properly claimed.

 

Giveaway does not include transfers to and from the airport near the Giveaway Winner's home or any spending money. It will be the responsibility of the Giveaway Winner and their guest to secure valid passports before traveling to Costa Rica.

 

5. GENERAL: 

By entering this Giveaway, Giveaway Entrants and Giveaway Winners: (1) agree to be bound by these Official Rules; (2) agree to release Sponsors, any prize provider, and the Released Entities from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death arising out of participating in this Giveaway, or the acceptance, possession, use or misuse of any prize and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery; and (3) consent to the use of his/her name, voice, picture, photos and likeness for advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law, and (4) acknowledge that Sponsors, any prize provider, and the Released Entities have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose.

 

Sponsors may discontinue this Giveaway at any time. Sponsors may terminate any Giveaway or decide to modify it in any manner that it deems fair and equitable to Giveaway Entrants if it becomes aware of any occurrence that would materially affect the Giveaway's security and fairness. Sponsors may prohibit individuals from participating in the Giveaway and disqualify entries if they (1) attempt to enter the Giveaway through any means other than as described in these Official Rules, (2) attempt to disrupt the Giveaway or circumvent the terms and conditions of these Official Rules in any way or (3) repeatedly show a disregard for the Giveaway's Official Rules or act (a) in an unsportsmanlike manner, or (b) with an intent to annoy, abuse, threaten or harass any Giveaway Entrants or Sponsors.

 

Sponsors' decisions with respect to the Giveaway are final.  

 

The information and photos that you provide in connection with the Giveaway or that are taken of you during the Giveaway may be used for Sponsors' internal purposes and to send you information about Sponsors' products and special promotions but will not be provided to third parties, except as necessary for the administration of the Giveaway or as required by law or legal process. Entry constitutes permission to the Sponsors and their agencies to use all Giveaway Entrants' names, love stories, photos and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. 6. LIABILITY AND RELEASE: 

By participating in this Giveaway, Giveaway Entrants agree to release and hold harmless Sponsors, any prize provider, and the Released Entities from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize hereunder, including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Giveaway or the processing of entries; (e) injury or death to a person(s) or damage to property which may be result, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or Giveaway Entrants receipt, acceptance, use &/or enjoyment of any prize; or (f) lost, late, postage due, misdirected, or undeliverable mail.

 

In no event shall the Sponsors, any prize provider or the Released Entities be liable for attorney's fees. Giveaway Entrants waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Sponsors, any prize provider, and the Released Entities reserve the right to correct typographic, clerical or printing errors in any Giveaway materials. Sponsors, any prize provider, and the Released Entities are not responsible for any typographical or other error in the printing of this Giveaway, the administration of the Giveaway or in the announcement of Giveaway Winner(s), including such error as may give an erroneous indication that a prize has been won. In the event the Sponsors, any prize provider or the Released Entities are prevented from continuing with this Giveaway, or the integrity and/or feasibility of the Giveaway is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor's, any prize provider’s or the Released Entities' control (each a "Force Majeure" event) the Sponsor, any prize provider, and the Released Entities shall have the right, in their sole discretion, to abbreviate, modify, suspend, cancel or terminate the Giveaway without notice or further obligation. If the Sponsor, any prize provider or the Released Entities, in their discretion, elect to abbreviate, cancel or terminate the Giveaway as a result of a Force Majeure event, the Sponsors, any prize provider, and the Released Entities reserve the right, but shall have no obligation, to award the prizes from among all Qualified Entrants received up to the time of such Force Majeure.

 

7. WINNERS LIST:

The name of the Giveaway Winner will be posted on the EnGAYged Weddings and The LGBT EXPO websites and can also be found by sending a self-addressed stamped envelope to 2015 EnGAYged Wedding EXPO Giveaway, 8147 Damara Drive - New Port Richey, Florida 34653. Requests must be received by May 30, 2015. Winners list will be completed after the Giveaway Winner has been confirmed.

 

8. DISPUTE RESOLUTION: 

Giveaway Entrant agrees that: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Giveaway Entrant(s) and Sponsors and their agencies, shall be governed by and construed exclusively in accordance with the laws of the State of Florida without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than the State of Florida.

 

Giveaway Entrant agrees that any action at law or in equity arising out of or relating to this Giveaway, or awarding of the prize, shall be filed only in the state or federal courts located in the County of Hillsborough in the State of Florida. Giveaway Entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Giveaway, Giveaway Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway, or awarding of the prize, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Giveaway but in no event attorneys' fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
